Last week the U.S. Supreme Court granted a Trump Administration request to stay a preliminary injunction in Orr v. Trump, allowing the government to enforce a discriminatory passport policy against transgender, nonbinary, and intersex people. As Justice Jackson noted in her dissent, for the past 33 years transgender Americans have been able to obtain U.S. passports with sex markers that match their gender identity. The Court’s decision, which affirms a cruel anti-LGBTQ+ Trump Executive Order signed days after he took office, is unconscionable, and will cause real harm to transgender, nonbinary and intersex Americans. BALIF strongly condemns the Supreme Court’s decision and continues to stand in solidarity with the transgender, nonbinary and intersex members of our community.
