BALIF Joins Emergency Amicus Brief in U.S. Supreme Court Case Defending LGBTQ Youth Access to Social Media

Last week, BALIF joined an emergency amicus brief submitted with the U.S. Supreme Court in NetChoice v. Fitch, urging the Court to vacate a Fifth Circuit decision that allowed a Mississippi law restricting minors' access to social media to take effect while its constitutionality is still being challenged.  The brief—filed by LGBT Tech and joined by co-signatories, The Trevor Project, PFLAG, Inc., Hacking the Workforce, and Fight for the Future—emphasizes the law’s chilling implications for Free Speech and the unique harms it poses to LGBTQ youth who use social media to connect with affirming online communities, to express themselves, and access critical information, including mental health resources, safe sex education, gender affirming care, and legal aid.

This is the second amicus brief filed by LGBT Tech BALIF has signed onto this year. Earlier in 2025, BALIF supported LGBT Tech’s amicus brief in Snap, Inc. v. Pina, a case before the California Supreme Court, asking the Court to preserve California’s social media privacy protections under the federal Stored Communications Act.
