Protecting Our Community: DHS Policy Update & Digital Privacy Resources

BALIF opposes the recent revision to the Department of Homeland Security (DHS) Office of Intelligence and Analysis (I&A) Policy Manual which removes gender identity from its list of protected classes in DHS’ personnel’s intelligence gathering. Previously, the manual explicitly safeguarded gender identity and sexual orientation, offering some protection against government overreach. The updated policy states, in relevant part:

"[I&A] Personnel are prohibited from engaging in intelligence activities based solely on an individual’s or group’s race, ethnicity, sex, sexual orientation, religion, country of birth, nationality, or disability."

Broadly defined, “intelligence activities” encompass various forms of information collection, surveillance, and analysis that the government can use to monitor individuals and groups. While these activities are often justified as necessary for law enforcement, they have historically been weaponized against marginalized communities, including LGBTQ+ individuals. Intelligence gathering has frequently been used to suppress dissent, intimidate activists, and erode civil liberties. The vague and expansive nature of these activities leaves them ripe for abuse, further endangering communities that already face systemic discrimination.
