Who is BALIF

BALIF 1980

Bay Area Lawyers for Individual Freedom (BALIF) is the nation’s oldest and largest association of lesbian, gay, bisexual and transgender (LGBTQI) persons in the field of law. Founded in 1980, BALIF represents its members’ interests in the wider San Francisco Bay Area. BALIF members and supporters include San Francisco Bay Area judges, lawyers, law students and legal workers.

BALIF was founded to encourage LGBTQI legal professionals to apply to become judges. At the time there were no openly LGBTQI judges. Today there are many!

BALIF also started the organization that grew to become the now-independent AIDS Legal Referral Panel, which has provided free and low-cost legal assistance to over 72,000 people since it was founded in 1983.

Today, BALIF’s mission has expanded. The group takes action on questions of law and justice that affect the LGBTQI community; strengthens professional and social ties among LGBTQI members of the legal profession; builds coalitions with other legal organizations to combat all forms of discrimination; promotes the appointment of LGBTQI attorneys to the judiciary, public agencies and commissions in the Bay Area; funds

scholarships for LGBTQI laws students and fellowships for public interest lawyers working on LGBTQI issues, and provides a forum for the exchange of ideas and information of concern to members of the LGBTQI legal community. BALIF also submits amicus briefs in cases affecting the LGBTQI community, sponsors resolutions to the Conference of Delegates of California Bar Associations, provides LGBTQI-focused continuing legal education opportunities and endorses candidates for judicial offices and legal elected positions.

The Annual Gala is one of the most popular BALIF events of the year. Many public officials attend the gala, past attendees have included legislators, mayors, district attorneys, labor commissioners, and other public officials, in addition to over 600 members of the community.

1980
BALIF founded with a focus on getting gay & lesbians on the bench, specifically Mary Morgan; membership predominantly male
1981
Mary Morgan appointed to bench; first board of directors elected; BALIF has 150 members
1982
BALIF board members lobby for Herb Donaldson’s appointment to San Francisco Municipal Court, and he is appointed; membership hits 225.
1983
BALIF creates AIDS Legal Referral Panel as a BALIF committee (this is a major BALIF focus until its growth naturally resulted in it becoming a separate organization in 1989)

First Annual G/L law Student Conference (this was a big BALIF event for many years, but has not been recently)

BALIF membership hits 300; Annual Dinner attended by 150 people (over 900 attended in 1995; in 2014, approximately 700)

1985
BALIF takes on Gay Legal Referral Service (GLRS is spun off from BALIF in 1995); LIFE Lobby founded- BALIF Board members very active in founding and early days of LIFE lobby; BALIF joins amicus brief in Bowers v. Hardwick, Supreme Court sodomy case, and filed an amicus brief in California seeking to require benefits for the same-sex “family partners” of state employees
1986
BALIF leadership has links to BASF; BALIF files two amicus briefs in the Supreme Court in 1986
1987
At March on Washington (Hardwick decided in 1985), BALIF Board caucused and agreed to host the first Lavender Law Conference
1988
Lavender Law Conference (600 attendees) and AIDS Law Conference (300 attendees), is held as a result of BALIF leaders/board members work; from there, the National Lesbian and Gay Law Association (NLGLA) is founded, NLGLA has hosted successive Lavender Law Conferences.
1989
ALRP spun off from BALIF (it had grown substantially – SP: this is just a word preference. “Tremendous” is used so often by POTUS that I’ve begun to abhor it.)
1991
BALIF delegates author resolution that became A.B. 2601, prohibiting employment discrimination on the basis of sexual orientation, which became law in 1992
1992
BALIF board member catches that the first ever State Bar Demographic survey does not solicit information about sexual orientation; leads effort that results in adding sexual orientation question (result of survey showed about 2 or 3% of State Bar is gay)
1993
BALIF successfully lobbies for State Bar to form committee on Sexual Orientation Discrimination

BALIF identifies tax reporting problem, gains tax exempt status as a 501(c) (6) nonprofit business association, and files appropriate returns

1994
BALIF creates Legal Workers Committee, and pushes for increased legal worker membership and involvement

BALIF publishes first inclusive public directory; members who do not wish to be included must affirmatively opt out of publication

BALIF files two amicus briefs in California state courts in support of CA’s “hate crime” statute and challenging a religious landlord’s refusal to rent to an unmarried couple

1995
Membership is about 550-600, including 340 lawyers, 30 (?)? legal workers and 180 (?) law students

BALIF joins Supreme Court amicus brief in Romer v. Evans and joins amicus briefs in Virginia state courts in a custody dispute between a different-sex couple, where the child’s mother was in a same-sex relationship

1996
BALIF members Kevin McCarthy and Kay Tsenin win contested elections for San Francisco Superior Court and Municipal Court, respectively
1997
BALIF instrumental in the passage of transgender antidiscrimination resolution in State Bar Conference of 
Delegates

Chief Justice Ronald M. George (California Supreme Court) keynote speaker at Annual Dinner; Justice Kathryn Werdegar also attends. BALIF hosts private reception for local LGBT judges with Supreme Court Justices

BALIF disbands Diversity Committee

BALIF joins a Supreme Court amicus brief in Oncale v. Sundowner Offshore Services, case holding that Title VII protects against all sex discrimination, including same-sex harassment; BALIF files brief in the Supreme Court in a case challenging the constitutionality of the Communications Decency Act of 1996

LIFE Lobby dissolves; formation of CAPE (California Alliance for Pride and Equality)

BALIF joins amicus brief in Supreme Court in case on application of Americans with Disabilities Act to individuals with HIV/AIDS

1999
BALIF successfully advocates for resolutions in the State Bar Conference of Delegates which add sexual orientation as a protected category under the Unruh Civil Rights Act and the Fair Employment and Housing Act

Transgender persons added to BALIF’s tag line

BALIF becomes incorporated (along with bylaw revisions)

BALIF’s 20th Anniversary

BALIF participates in state-wide domestic partnership registry effort by hosting notary service at Annual Dinner for domestic partner registration

Bylaws revised to include transgender persons in gender equity; BALIF files amicus brief with U.S. Supreme Court in Boy Scouts case; BALIF files amicus brief in California in support of retroactive application of amendments to California’s law prohibiting sex discrimination in employment

BALIF embarks on a campaign to diversify its Board of Directors to reflect differences in the racial, ethnic, geographical, and work environments of the membership it represents

BALIF files amicus brief in Ninth Circuit sex discrimination case and files briefs in California courts in challenge to “Don’t Ask, Don’t Tell” regulations and wrongful death case on behalf of same-sex partner; BALIF joins amicus brief in the Third Circuit in support of First Amendment challenge to Child Online Protection Act

BALIF lends its support to Permanent Partners Immigration Act and opposed the internet “protection” acts to block LGBT websites from public libraries

BALIF files amicus brief in the Ninth Circuit challenging policy on gays and lesbians in the military and files brief in the D.C. Court of Appeals concerning application of D.C. Human Rights statute to Boy Scouts; BALIF joins brief in the Massachusetts Supreme Court in the Goodridge marriage equality case

2003
BALIF becomes a full member of the Minority Bar Coalition, joining forces with more than 15 other local bars representing diverse segments of lawyers

BALIF joins amicus brief in the U.S. Supreme Court in Lawrence v. Texas, joining others in the successful campaign which culminated in having all anti-sodomy laws struck down across the country; BALIF joins amicus brief filed in California in support of second-parent adoption by same-sex partners

2005
BALIF celebrates 25th Anniversary; honors all LGBT Bay Area Judicial Officials with its Community Award; over twenty judges, magistrates, and commissioners appear on stage at Annual Dinner to accept the award, including BALIF founders Mary Morgan, Herb Donaldson, and Donna Hitchens.

BALIF hosts the Minority Bar Coalition annual event for the first time

BALIF joins three amicus briefs in California courts regarding parental rights of lesbian/gay parents; BALIF files Supreme Court brief in case challenging Solomon Amendment, which conditioned institutions of higher education’s receipt of federal funds on permitting military to recruit on campus notwithstanding discriminatory policies

2006
BALIF files brief in the California Supreme Court concerning Berkeley’s requirement that group affiliated with Boy Scouts provide assurances of nondiscrimination to qualify for free use of berths in the city’s marina
2007
BALIF joins a brief in the Ninth Circuit in case involving UC Hasting’s nondiscrimination policy and a religious student group that sought to use facilities despite admittedly discriminating on the basis of sexual orientation and religion.
2008
BALIF files brief in the California Supreme Court in case challenging California’s statutory ban on same-sex marriage.

BALIF celebrates the California Supreme Court’s decision legalizing same sex marriage. Several months later, BALIF spent endless time, talent, and energy (and donated $25,000!) in the fight against Proposition 8.

BALIF joins amicus briefs in California Supreme Court in cases concerning rights of same-sex parents.

2009
BALIF files brief in the California Supreme Court in case challenging constitutionality of Proposition 8.
2010
BALIF passes several resolutions at the Conference of Delegates advancing the rights of transgender persons. For example, BALIF passed a resolution that would remove the surgery requirement for persons to changing their gender on their birth certificate.

BALIF files briefs in U.S. District Court and in the Ninth Circuit challenging Proposition 8.

2011
BALIF’s annual dinner becomes a “gala” and is held at the San Francisco Museum of Modern Art.
 
BALIF celebrates one of its members, Victoria Kolakowski, being elected the first transgender judge in the nation.

BALIF launches “It Gets Better” video series emphasizing not only that it gets better, but what members are going to “make it better.”

BALIF files district court brief in opposition to a motion to vacate the decision overturning Proposition 8 based on Judge Walker’s alleged bias.

2012
BALIF wins the prestigious California State Bar Diversity Award

BALIF files amicus brief in the Ninth Circuit in Golinski and in the Supreme Court in Perry v. Schwarzenegger. Joined amicus brief in the Supreme Court in United States v. Windsor.

Celebrated BALIF member, Tara Flanagan, being elected as an openly lesbian judge to the Alameda County Superior Court.

BALIF celebrates 30 years of alumni with the first-everHomecoming, and launches Community Volunteer Initiative program.

2013
BALIF celebrates with Justice Jim Humes, the first openly gay Justice appointed to the California Court of Appeal.

BALIF files amicus brief in the Ninth Circuit in support of marriage equality in cases challenging Hawaii’s and Nevada’s same-sex marriage bans.

2014
BALIF files amicus briefs in support of marriage equality in the Fourth, Fifth, Sixth, Seventh, Ninth, and Tenth Circuits.
2015
BALIF celebrates its 35th anniversary.

BALIF files amicus brief in the U.S. Supreme Court in Obergefell case on marriage equality.

BALIF files an amicus brief in the Ninth Circuit in support of a transgender woman prisoner seeking medical care in Norsworthy v. Beard

2016
BALIF files brief in 4th Circuit case challenging North Carolina’s discriminatory law targeting transgender people for discrimination in public schools and facilities and bars transgender people from using restrooms consistent with their gender identity.

BALIF joins amicus briefs in the U.S. Supreme Court in reproductive freedom and immigrants’ rights cases

BALIF celebrates its founding members with the event: BALIF’s Past, Present and Future: Celebrating our History and Looking at the LGBT Civil Rights Battles Ahead. This Event had over 100 attendees and featured a panel of BALIF Founders, including Judge Donna Hitchens (Ret.), Carl Wolf, Fred Hertz, and Nanci Clarence. Kate Kendall spoke about our future challenges.

2017
BALIF files brief in Supreme Court in case brought by transgender student challenging school board’s discriminatory bathroom policy that segregates trans students from their peers.

BALIF joins amicus brief in New Jersey in case addressing importance of allowing transgender people to bring claims under the Americans with Disabilities Act when they’ve experienced discrimination on the basis of gender dysphoria.

2018
BALIF Foundation held its first Silent Auction at the BALIF Annual Gala to raise funds for scholarships and fellowships through the 501(c)3 arm of BALIF.

BALIF held its first Letter Writing happy hour. Those that attended, wrote letters to local and national leaders regarding the Kavanagh confirmation hearings. At the end, BALIF dropped over 25 letters in the mail written by our members.

The Community Activism Committee successfully brought back our legal clinics and partnered with the LGBT Center in San Francisco. A great group of volunteers has gathered to help the community with legal services (Family Law, Immigration Law, Employment Law, Health Care, Name/Gender Change).

BALIF Programs Committee Presents- Honoring Julius Turman: Reflections on Intersectional Advocacy in the Legal Profession Event. The event had over 60 attendants at Pillsbury Winthrop Shaw Pittman LLP with a wonderful reception and a panel with Susan Christian, David Tsai, Angela Padilla, and David Campos. Moderated by Brandon Lawrence and co-sponsored by the Charles Houston Bar Association.

BALIF added a “Q” and “I” to “An LGBT Bar Association. The new Logo now is – BALIF, An LGBTQI Bar Association.

2019
BALIF held its first QTPOC Leadership Brunch that brought together 35 QTPOC members in Oakland and it was a huge success. BALIF is hoping to continue this event annually.

BALIF reunited with ACS for a Judge’s Reception “Off the Record” at Orrick. It was very well attended. BALIF had not done this event in a few years and hopes to continue to stay in contact and co-sponsor more events with ACS in the future.

BALIF created the Diversity and Inclusion Committee and the Governance Committee

2020
BALIF celebrates its 40th anniversary. The BALIF 40th Gala was a huge success with over 550 people. This was the last large event that took place in San Francisco hours before a city mandated shelter in place due to the Covid-19 pandemic.

BALIF includes treasurer’s reports, minutes, and committee reports on website to increase transparency, thanks to Governance Committee.

Diversity Equity Inclusion Officer position is created, expanding upon the Diversity and Inclusion Committee.

Julius Turman Award was created by the BALIF Foundation.

BALIF launched the first version of Year in Review through a digital magazine highlighting the organization’s accomplishments from the last year

2021
BALIF hosts its first virtual gala celebrating with iconic drag performers and raising the most it ever has in its 41-year history.
2022
BALIF successfully hosted its second virtual gala by pivoting quickly from an in-person event to a virtual event. BALIF offered and hosted an in-person after party for those that felt comfortable gathering.

BALIF finalized and adopted updated bylaws.

BALIF held the Halloween Fundraiser and Holiday Party back in person

BALIF went back to an in person Gala with over 500 in attendance

BALIF resumed all events back to in-person events.
